TERMS OF USE

1. BUSINESS INFORMATION

The online store SUCUS (hereinafter
the “Eshop”) is a commercial activity of the sole proprietorship of Tsakanikas
Sotirios (hereinafter the “Business”), with the following details:

The use of the Eshop and
transactions conducted through it are governed by these Terms, the applicable
Greek and European consumer protection legislation, e-commerce laws, and, where
applicable, Regulation (EU) 2022/2065 (Digital Services Act - DSA). Law
2251/1994 regulates distance selling contracts, while Presidential Decree
131/2003 constitutes the Greek legal framework for electronic commerce.

2. SUBJECT OF THE ESHOP

The Eshop offers handmade plant
pots and related decoration/planting products, manufactured and/or distributed
by the Business, primarily made of fiberglass reinforced with resin.

Product photos, colors, dimensions,
and technical descriptions are provided for informational purposes. Due to the
handmade nature of the products, minor variations in color, texture, finish,
weight, or dimensions may occur and shall not be considered defects, provided
they do not materially affect the intended use or agreed characteristics of the
product.

3. ACCEPTANCE OF TERMS

Accessing, browsing, and using the
Eshop, as well as placing an order, implies unconditional acceptance of these
Terms.

The Business reserves the right to
modify these Terms at any time by publishing an updated version on the Eshop. Any modifications
shall not affect orders already completed.

4. CONDITIONS OF USE

Users declare that they:

  • have legal capacity to enter into contracts,
  • provide true, accurate, and complete
    information,
  • do not use the Eshop in violation of
    applicable laws, good practices, or these Terms.

The following are strictly
prohibited:

  • malicious use of the Eshop,
  • breach of security systems,
  • unauthorized automated data extraction,
  • posting illegal, offensive, or misleading
    content (where applicable, e.g. reviews/comments).

5. USER REGISTRATION

Where account creation is
available, users must provide accurate and complete information. Users are
responsible for maintaining the confidentiality of their login credentials and
for all activity conducted under their account.

The Business reserves the right to
suspend or delete user accounts in case of violation of these Terms or
applicable law.

6. PRODUCT INFORMATION –
AVAILABILITY

The Business makes every reasonable
effort to ensure that product information is accurate, clear, and up to date.

Product availability is indicative
and may change without prior notice, especially for:

  • handmade products,
  • custom-made items,
  • limited availability products,
  • personalized orders.

In case a product becomes
unavailable after an order has been placed, the Business shall inform the
customer without undue delay and propose:

  • a new delivery date,
  • an equivalent product (only with the
    customer’s explicit consent), or
  • order cancellation and full refund.

7. PRICES – TAXES – SHIPPING COSTS

All prices are listed in Euro (€)
and include VAT unless otherwise explicitly stated.

Before completing an order, the
customer is clearly informed about:

  • the total product price,
  • applicable VAT,
  • shipping or delivery costs,
  • any additional charges,
  • available payment methods.

Clear pre-contractual information
on total pricing is a key obligation in distance contracts.

7.1 Discounts – Previous Price

In case of price reduction
announcements, the Business displays the previous price in accordance with
applicable legislation (Omnibus Directive rules / Law 4933/2022), i.e.,
typically the lowest price applied during the relevant prior period where
required.

8. ORDER PROCESS – PAYMENT
OBLIGATION

Orders are placed through the
technical steps of the Eshop.

Before final submission, customers
have the ability to:

  • review selected products,
  • correct errors,
  • confirm shipping and billing details,
  • select payment and delivery methods.

The order completion button must
clearly indicate that placing the order implies a payment obligation (e.g.,
“Order with Obligation to Pay” or equivalent wording).

An automated order confirmation
email does not necessarily constitute acceptance of the order. The contract is
considered concluded when the Business sends an explicit order
acceptance/processing confirmation or dispatches the product, depending on the
operational process.

9. ADVERTISING – PROMOTION –
PRODUCT RANKING

If the Eshop uses:

  • sponsored product placements,
  • paid rankings,
  • featured products,
  • influencer collaborations or affiliate
    links,

such practices must be clearly
disclosed where required, in order to avoid misleading commercial practices or
hidden advertising, in accordance with applicable legislation.

10. INTELLECTUAL PROPERTY

All Eshop content, including but
not limited to:

  • logos,
  • trademarks,
  • product designs,
  • photographs,
  • texts,
  • graphics,
  • layout,
  • catalog files,

belongs to the Business or its
lawful owners and is protected under applicable intellectual and industrial
property laws.

Any reproduction, copying,
modification, distribution, or commercial exploitation without prior written
permission is prohibited.

11. LIMITATION OF LIABILITY

The Business shall be liable only
for intent and gross negligence, except where otherwise provided by law,
particularly in cases where mandatory consumer rights apply.

The Business shall not be liable
for:

  • temporary unavailability of the Eshop,
  • technical failures of third-party providers,
  • network interruptions,
  • force majeure events.

Nothing in these Terms shall limit
mandatory consumer rights.

12. CONTACT / LEGAL COMPLIANCE
REPORTS

For matters related to:

  • orders,
  • returns,
  • defective products,
  • reporting illegal content (where
    applicable),
  • legal requests,
  • intellectual property infringements,

13. ALTERNATIVE DISPUTE RESOLUTION

Consumers may, where applicable,
refer to:

  • the Greek Consumer Ombudsman, and/or
  • other authorized alternative dispute
    resolution bodies.

14. APPLICABLE LAW – JURISDICTION

These Terms are governed by Greek
law and applicable European Union law.

For consumer disputes, mandatory
consumer protection rules of the consumer’s place of residence shall apply
where required.

The competent courts are those of
Athens, Greece.
